1. Type and purpose of data processing

On our website/application, we provide a comment field and a field for uploading an image.

• The comment text you entered will be transmitted to our servers in Germany.
• The image you selected will not be transmitted to our servers. The image will be processed exclusively on your device (client).
• Image analysis (e.g., content recognition, tag or metadata generation) is performed exclusively locally in your browser or in the application you are using.
• Only the analysis results derived from the image in the form of JSON data , as well as your comment text, will be transferred to our servers in Germany and processed there temporarily.

The purposes of processing are in particular:

• Provision and use of the comment and analysis function,
• Technically necessary processing for displaying and transmitting your entries,
• Ensuring the integrity and security of the service (e.g., abuse detection).

The legal basis for processing is regularly

• Article 6 paragraph 1 letter b GDPR , insofar as the processing is necessary for the performance of the contract and for the provision of the function, and
• Article 6 paragraph 1 letter f GDPR , insofar as we have a legitimate interest in the secure and technically sound provision of our online service (in particular IT security, prevention of misuse).

2. No image transmission, processing only local.

The image you select or create will be processed exclusively on your device:

• The image itself is not transmitted to our servers.
• We never have access to the original image file.
• Image processing (analysis, recognition, conversion) takes place exclusively on the client; the image is not passed on to other servers or third parties.

To the extent that the image contains personal data, the processing of the image remains entirely under your technical control on your device. We, as the data controller, only process the analysis results derived from the image (JSON data), not the image itself. The relevant regulations are, in particular, Article 4, paragraphs 1 and 2 of the GDPR (definitions of “personal data” and “processing”).

3. Categories of processed data

Within the scope of this function, the following data categories in particular can be processed:

• Comment text (freely entered content that may contain personal data, e.g. name, contact details, opinions),
• Metadata and analysis results derived from the image in JSON structure (e.g., recognized objects, categories, technical parameters),
• Possibly technical log data required for the operation of the service (e.g., time of use, session ID).

4. Storage location and recipient

• The JSON data and the comment text are processed exclusively on our servers in Germany.
• This data will not be transferred to recipients in third countries outside the EU/EEA within the meaning of Art. 44 et seq. GDPR .
• Data will only be disclosed to third parties if we are legally obligated to do so (e.g., pursuant to Art. 6 para. 1 lit. c GDPR ) or if this is necessary for legal defense ( Art. 6 para. 1 lit. f GDPR ).

5. Storage duration / Session-based processing

The JSON data and the comment text are processed exclusively on a session basis :

• Processing only takes place for the duration of your active session.
• After the session ends, all resulting data will be deleted from our systems.
• According to the current state of technology, data recovery after the session ends is not possible.

In doing so, we comply in particular with the principle of storage limitation pursuant to Art. 5 para. 1 lit. e GDPR and the principle of data minimization pursuant to Art. 5 para. 1 lit. c GDPR .

6. Not for use in AI/machine learning training

The data processed within this function (comment text and JSON analysis results)

• will be used exclusively to provide the described function during your session,
• will not be used to create user profiles,
• not for personalized advertising and
• Not used for training AI/machine learning models.

Further use of the data for analysis, profiling or training purposes within the meaning of Art. 6 para. 1 GDPR does not take place.

7. Security of processing

We take appropriate technical and organizational measures to ensure a level of protection for your data appropriate to the risk (e.g., access restrictions, transport encryption) in accordance with Article 32 GDPR .
Since the original image does not leave your device, the risk of unauthorized access to this image is further reduced.

8. Obligation to provide the data

Providing data in the comment field and selecting an image is voluntary. However, without this information, certain functions (e.g., displaying or evaluating your input) cannot be used or can only be used to a limited extent. The legal basis for this is, in particular, Article 6(1)(b) and (f) of the GDPR .

9. Your rights as a data subject

With regard to the processing of personal data, you have the following rights under Articles 15 to 21 of the GDPR :

• Right of access (Art. 15 GDPR),
• Right to rectification (Art. 16 GDPR),
• Right to erasure (Art. 17 GDPR),
• Right to restriction of processing (Art. 18 GDPR),
• Right to data portability (Art. 20 GDPR),
• Right to object (Art. 21 GDPR).

Since we only process the data for the duration of the session and then delete it, certain rights (in particular, access and erasure) can no longer be exercised after the session ends because we no longer retain the corresponding data. We are informing you of this in accordance with Article 13 of the GDPR .

Furthermore, you have the right to lodge a complaint with a data protection supervisory authority ( Art. 77 GDPR ).
